Topamax® or topiramate is a medication prescribed to treat epilepsy and seizures. Manufactured by Ortho-McNeil Pharmaceuticals, this drug has been prescribed to more than 800,000 patients since it was introduced into the marketplace in the late 1990s.

History of Topamax®

Drug Recall AttorneysThis medication was approved by the Food and Drug Administration (FDA) in December of 1996 for the purpose of total and partial seizures. Women who were pregnant and prone to seizures would take this medication to prevent seizures during pregnancy and causing harm to their fetus. Sadly, the drug itself would soon be connected to birth defects. If your baby has suffered a birth defect while you were taking this drug, consult an Arizona Topamax® attorney immediately to discuss your product liability claim.

The FDA’s Statement

After the FDA received reports of cleft palates and other birth effects becoming associated with the use of Topamax®, the Administration issued a statement in March of 2011: “alternative medications that have a lower risk of oral clefts and other adverse birth outcomes should be considered for these patients.” The FDA also stated that malformations are most common when pregnant women take Topamax® in their first trimester.

After this public statement, the drug manufacturer was required to include a warning label on the medication. The FDA also moved the medication from a “Pregnancy Category C” drug to the more dangerous “Category D” classification. A pregnancy Category D means that there is concrete evidence the medication can cause danger to a fetus.

Topamax® Birth Defects

Some of the birth defects linked to Topamax® include:

  • Cleft Lip
  • Cleft Palate
  • Genital Defects
  • Fetal and skeletal malformations

A cleft lip or cleft palate is the result of a fetus’ mouth failing to form completely, which results in a gap in the roof of their tiny mouths. This type of deformity can lead to developmental issues, ear infections and difficulty speaking and eating.
